1. Introduction

    Anchor Land Holdings, Inc. and its subsidiaries (collectively referred to as “ALHI Group”, “we”, “us” or “our”)­­­ values the privacy and confidentiality of the personal data of our clients, customers, employees, partners, other stakeholders, and others whom we interact with in the course of providing our products and services. ALHI Group is committed to ensure that we implement policies, practices and processes to safeguard the collection, use and disclosure of personal data and adopt and observe appropriate standards for personal data protection in accordance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, and its Implementing Rules and Regulations, other issuances of the National Privacy Commission and other relevant laws of the Philippines (collectively, the “DPA”).

    This Policy seeks to inform you on what personal data we collect, how we collect, use, disclose, process, protect and retain your personal data that is in our possession.

    This Policy covers both our online and offline data collection activities, such as, but not limited to, personal data that we collect through our various channels such as websites, apps, third party social networks, buyer’s information sheet, purchase agreement, reservation application and other similar forms, and CCTV recording around our premises.

  2. What Personal Data May We Collect From You

    In this Policy, the terms, “data” and “information” are used interchangeably. “Personal data” includes the concepts of personal information, sensitive personal information, and privileged information. The first two typically pertains to information that is used to distinctively to identify an individual. For their exact definitions, please refer to the text of the DPA.

    We gather and collect the following types of information in relation to our transactions and dealings, which may include, but not limited to, the following:

    • Your name, gender, nationality, civil status, age, date of birth, mailing address, email address, proof of identification, residence, office, and, phone numbers, and other information relating to you, as a result and as part of our transactions and dealings with you.
    • Your resume when you apply for an employment with us, which contains your employment history, personal details and your educational background.
    • Your credit card information, credit history and bank account when you avail of our products and services.
    • Your company information, performance, history, and financial and capital, when we enter into business transactions or partner with you.
    • Any information you submit to our customer relations agents, marketing and sales and account management.
    • Tracking information which our web server automatically recognizes each time you visit our site as well as your social media behavior, such as but not limited to, information obtained by browsing into our website, by downloading mobile applications and by tagging or mentioning us on your social media accounts.

    Similarly, when you provide another person’s information (i.e your dependent, spouse, children and/or parents), you hereby attest that you have obtained the consent and authority of the owner of such information to allow us to process and/or disclose such information in accordance with our policy.

  3. How We Use Your Personal Data

    We use the personal data you provide us for one or more of the following purposes:

    • To process the products and services that you have availed from us.
    • To prepare all necessary documentation for the sale or lease of properties owned/managed by us.
    • To perform financial processes related to the sale such as financing, amortization, and other acts necessary to implement sale contracts.
    • To send you statements, billings, notices, and other similar documents necessary in relation to the transactions you entered with us.
    • To carry out our obligations arising from any contracts entered between you and us.
    • To communicate our latest products, services, promos and events.
    • To address your needs, request, queries and complaints.
    • To conduct due diligence.
    • To comply with the requirements of the law and all legal orders and processes.
      Any other purpose similar or similar in nature to any of the above.
  4. Who We Disclose Your Personal Data To

    We may share your personal data, depending on the product and service that may be applicable to you, to the following:

    • ALHI Group’s employees, personnel and officers.
    • Professional advisers such as lawyers and auditors.
    • Banks, insurers and credit providers and their respective service provider.
    • Any third-party service providers that have been contracted to perform financial, technical, architectural, and other administrative services.
    • Government institution and other relevant authorities when required by law, rules and regulations.

    In addition to the abovementioned, we may also disclose your personal data subject to the same requirement and compliance with the DPA and relevant laws and as reasonably necessary to Anchor Land Holdings, Inc. and all its subsidiaries and affiliates.

  5. How We Manage The Collection, Use And Disclosure Of Your Personal Data

    • Obtaining Consent

      Prior to the collection, use and disclosure of your personal data, we will notify you of the purpose why we are doing so. We will obtain written confirmation from you on your expressed consent. The consent obtained is time-bound in relation to the declared, specified and legitimate purpose. We will seek renewed consent from you if the original purpose for the collection, use or disclosure of your personal data has changed.

      Under certain circumstances, we may assume deemed consent from you when you voluntarily provide your personal data for the stated purpose, e.g. when you apply for a job with us using our job application forms.

    • Withdrawal of Consent

      You may wish to withdraw consent by giving us reasonable advance notice. We will advise you of the likely consequences of your withdrawal of consent, e.g. without your personal data we may not be able to fulfil our obligations under a contractual agreement or to inform you of our future products or services.

      However, this will not affect the lawfulness of the processing that was carried out before you withdrew your consent or ALHI’s right to continue parts of the processing based on other legal bases than your consent.

  6. How Long Do We Keep Your Personal Data

    Your personal information shall be retained for as long as the purpose for which it was collected, and such other purposes that you may have consented to from time to time, remains in effect and until such time as it is no longer required nor necessary to keep your information for any other legal, regulatory or business purposes.

    Your personal data will thereafter be disposed or discarded in accordance with retention limit set by our industry standards, laws and regulations and in a proper and secure manner.

  7. How We Protect Your Personal Data

    We hold in high regard the integrity, confidentiality and security of your personal data. We have implemented technical, physical and organizational security measures to protect your information from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful activities.

    We put in placed the following safeguards:

    • Utilize the use of secured servers behind a firewall, encryptions and other security controls.
    • Giving access only to those who are qualified and authorized personnel to process your personal data.
    • Third party personnel or organization who may be commissioned to process your personal data is required to do so with strict confidentiality and privacy consistent with our privacy policy.
  8. What Are Your Rights With Respect To Your Personal Data

    Your rights with respect to your personal data are as follows:

    • Right to Information: You have the right to be informed that your personal data will be, are being, or were, collected and processed.
    • Right to Object: You have the right to object to the processing of your personal data by objecting or withholding your consent previously provided upon data collection.
    • Right to Access: Upon demand, you have the right to reasonable access to the contents of your personal data.
    • Right to Rectification: You have the right to dispute the inaccuracy or error in the personal data and have it immediately and accordingly corrected, unless the request is vexatious or otherwise unreasonable.
    • Right to Erasure or Blocking: Based on reasonable grounds, you have the right to suspend, withdraw or order the blocking, removal or destruction of your personal data from ALHI’s filing system.
    • Right to Damages: Subject to the results of verification of investigation, you may be indemnified for any damages sustained due to unauthorized use of your personal data.
    • Right to Data Portability: Where your personal data is processed by electronic means and in a structured and commonly used format, you have the right to obtain a copy of such data in an electronic or structured format.
    • Right to File a Complaint: If you feel that your personal data has been misused, maliciously disclosed, or improperly disposed of, or that any of your data privacy rights have been violated, you have the right to file a complaint with Anchor Land Holdings, Inc. at alhidataprivacy@anchorland.com.ph

    We use “cookies” to collect information about your online activity on our website.
